WIRA Forum Terms of Use

These Terms of Use govern your access to and use of the official WIRA Forum at http://forum.wira.org (the “Forum”), which is operated by RICRYM SDN BHD (“RICRYM”, “Company”, “we”, “us”, or “our”).

These Terms apply only to your use of the Forum. Other WIRA products and services, including the game, launcher, websites, patches, downloadable content, test environments, and related services, may be governed by separate terms.

By accessing, browsing, registering for, or using the Forum, you agree to these Terms. If you do not agree, you must not use the Forum.

Important Terms

These Terms contain important provisions affecting your rights and responsibilities, including provisions relating to acceptable conduct, user content, moderation, disclaimers, limitation of liability, indemnity, termination, and dispute resolution.

Eligibility and Use of the Forum

Your use of the Forum is subject to the following conditions:

  1. You must have the legal capacity to agree to these Terms under the laws that apply to you.

  2. If you are below the age of majority in your jurisdiction, you may only use the Forum with the consent and supervision of a parent or legal guardian.

  3. You may not use the Forum if the Company has suspended, restricted, or prohibited your access.

  4. You must use the Forum in accordance with these Terms, any applicable Community Guidelines, and any rules or notices published by the Company from time to time.

  5. Your permission to use the Forum is limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable, and for lawful personal use only.

Acceptable Use

You agree that you will not, directly or indirectly:

  1. use the Forum in violation of any applicable law, regulation, or third-party right;

  2. use or attempt to use another person’s account without permission;

  3. impersonate any person or entity, misrepresent your identity or affiliation, or falsely suggest endorsement by the Company;

  4. submit spam, advertisements, chain messages, scams, phishing attempts, deceptive promotions, or other unsolicited content;

  5. buy, sell, transfer, rent, trade, or solicit Forum accounts, usernames, access rights, or related identifiers;

  6. harass, threaten, abuse, stalk, defame, dox, discriminate against, or otherwise harm others through the Forum;

  7. post or distribute content that is unlawful, fraudulent, misleading, malicious, or disruptive;

  8. upload, transmit, or distribute malicious code, spyware, harmful executables, ransomware, or any material intended to damage systems or users;

  9. automate access to the Forum through bots, crawlers, scripts, scraping tools, browser automation, or similar means, except for lawful indexing by a publicly available search engine;

  10. interfere with, damage, disable, overburden, test vulnerabilities of, or gain unauthorised access to the Forum, its systems, infrastructure, databases, or connected services;

  11. bypass or interfere with security measures, moderation controls, access restrictions, or technical protections of the Forum;

  12. use the Forum, its data, or its community spaces to train models, scrape data, build datasets, or support competing services without the Company’s prior written permission;

  13. use the Forum for unauthorised commercial intelligence gathering, competitor monitoring, or market surveillance; or

  14. encourage, organise, assist, or facilitate any of the above.

Content Standards

You may not submit, post, upload, link, or otherwise make available content on the Forum that:

  1. is illegal, abusive, hateful, obscene, threatening, harassing, discriminatory, or otherwise harmful;

  2. infringes intellectual property rights, privacy rights, confidentiality obligations, or any other rights of another person or entity;

  3. contains malicious code or harmful technical material;

  4. includes confidential, private, or personal information that you do not have the right to disclose;

  5. falsely implies that it is official, endorsed, sponsored, or approved by the Company when it is not;

  6. is intended mainly to reserve names, hold space, manipulate visibility, or disrupt normal discussion;

  7. promotes cheating, exploits, unauthorised automation, hacks, account abuse, fraud, or other conduct harmful to WIRA, its players, or its services.

Accounts and Security

You may be required to create an account to access certain features of the Forum.

If you create an account:

  1. you must provide accurate, current, and complete information, including a valid email address where required;

  2. you must keep your account information updated;

  3. you are responsible for maintaining the confidentiality of your login credentials and account access tools;

  4. you are responsible for activity conducted through your account unless caused solely by the Company’s gross negligence or wilful misconduct; and

  5. you must notify the Company promptly if you become aware of unauthorised access, suspected compromise, impersonation, leaked credentials, or any other security issue relating to your account.

The Company may require verification of identity, ownership, account activity, or security details before assisting with account-related requests.

User Content

  1. You remain responsible for any content you create, post, upload, submit, message, or otherwise make available on the Forum, including usernames, profile information, posts, replies, images, attachments, feedback, and other materials (“User Content”).

  2. You confirm that you have the necessary rights to submit your User Content and that it does not violate these Terms, any law, or any third-party rights.

  3. As between you and the Company, you retain ownership of your User Content. However, by posting or submitting User Content on or through the Forum, you grant the Company a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, reproduce, publish, display, communicate, distribute, adapt, moderate, and otherwise use that User Content as reasonably necessary to operate, maintain, secure, moderate, improve, promote, and provide the Forum and related WIRA services.

  4. You agree that the Company is not obliged to store, preserve, or provide copies of User Content, and may remove or restrict it in accordance with these Terms.

  5. If User Content is removed from the Forum, the licence granted to the Company will end within a reasonable period after the last remaining copies are removed from the Company’s active systems, subject to backup, archival, legal, security, moderation, and compliance requirements.

  6. You must not submit User Content that wrongly implies official status, endorsement, or approval by the Company.

Moderation and Enforcement

To protect the Forum, WIRA, its community, and its operations, the Company may, subject to applicable law:

  1. monitor Forum activity, reports, logs, account activity, and technical indicators;

  2. investigate suspected violations of these Terms, Community Guidelines, or applicable law;

  3. remove, edit, redact, restrict, review, retain, or disclose content where reasonably necessary for moderation, operations, legal compliance, enforcement, security, or investigation; and

  4. take enforcement action including warnings, post removal, topic closure, chat or posting restrictions, account suspension, account termination, device or access restrictions, and any other appropriate action.

The Company is not required to provide advance notice before taking moderation or security action where doing so may compromise investigations, safety, security, or the integrity of the Forum or WIRA.

Privacy and Data

Your use of the Forum may involve the collection, use, disclosure, storage, transfer, and other processing of personal data, account data, device data, support records, security logs, and related information in accordance with the Company’s Privacy Policy and applicable law.

The Company may process such information as reasonably necessary to:

  • operate and maintain the Forum;
  • manage user accounts;
  • detect abuse, fraud, or security threats;
  • moderate content and behaviour;
  • comply with legal obligations; and
  • improve services.

Where required by law, the Company will provide notices and obtain consents as necessary.

Intellectual Property

  1. The Forum, including its software, structure, design, branding, text, graphics, features, and related intellectual property rights, is owned by or licensed to the Company and protected by applicable law.

  2. WIRA, its names, logos, symbols, branding, game elements, and related materials may be protected by copyright, trademark, and other intellectual property laws.

  3. Your use of the Forum does not give you ownership of the Forum, WIRA, or any part of them.

  4. Except where expressly permitted by law or by the Company in writing, you may not copy, modify, reproduce, reverse engineer, frame, mirror, data-mine, scrape, or otherwise exploit the Forum or its content.

Disclaimers

To the maximum extent permitted by applicable law, the Forum is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, statutory, or otherwise.

The Company does not guarantee that the Forum will always be available, uninterrupted, secure, error-free, or free from harmful components.

The Forum may contain links to or integrations with third-party sites or services. The Company does not control and is not responsible for their content, availability, terms, or privacy practices.

Limitation of Liability

To the maximum extent permitted by applicable law, the Company will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for any loss of profits, revenue, goodwill, data, business opportunity, or loss of access arising out of or relating to the Forum or these Terms.

To the maximum extent permitted by applicable law, users are not entitled to monetary compensation arising from moderation action, account restriction, account suspension, mistaken enforcement action, interruption, downtime, removal of content, closure of topics, security action, or discontinuation of any part of the Forum.

Nothing in these Terms excludes any rights or remedies that cannot legally be excluded under applicable law.

Indemnity

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the Company and its affiliates, licensors, service providers, officers, directors, employees, contractors, and agents from and against claims, losses, liabilities, damages, judgments, costs, and expenses, including reasonable legal fees, arising out of or relating to:

  1. your breach of these Terms;
  2. your misuse of the Forum;
  3. your User Content;
  4. your violation of applicable law; or
  5. your infringement of any third-party rights.

Termination

These Terms remain in effect until terminated by you or the Company.

You may stop using the Forum at any time and may request account closure, subject to applicable legal, operational, retention, moderation, and security requirements.

The Company may suspend, restrict, or terminate your access to the Forum if you breach these Terms, create risk or liability, compromise security, infringe rights, engage in abuse or fraud, or where the Company reasonably decides to discontinue the Forum or any relevant part of it.

If your access ends, your right to use the Forum ends immediately.

Any provisions that by their nature should survive termination will continue to apply, including provisions relating to intellectual property, moderation, disclaimers, limitation of liability, indemnity, disputes, and accrued rights and obligations.

Governing Law and Disputes

These Terms and any dispute, claim, or controversy arising out of or relating to these Terms or the Forum shall be governed by and construed in accordance with the laws of Malaysia, excluding its conflict of laws principles.

Subject to any mandatory rights or remedies you may have under applicable law, you agree that disputes arising out of or relating to these Terms or the Forum shall be submitted to the courts of Kuala Lumpur, Malaysia.

Nothing in these Terms limits any rights or remedies that cannot be excluded under applicable law.

The Company may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property, systems, operations, confidential information, community safety, and security interests.

Changes to These Terms

The Company may revise these Terms from time to time.

If the Company makes material changes, it will take reasonable steps to provide notice before those changes take effect, unless immediate changes are required for legal, security, operational, or abuse-prevention reasons.

Notice may be provided through the Forum, website, launcher, email, account notice, or other appropriate means.

Unless otherwise stated, updated Terms take effect on the date specified in the updated version.

If you do not agree to the updated Terms, you must stop using the Forum before the updated Terms take effect.

Your continued access to or use of the Forum after the effective date of the updated Terms constitutes your acceptance of the updated Terms, to the extent permitted by applicable law.
